These Terms and Conditions ("Terms") govern the services provided by Retro Media Transfer Lab (“we,” “our,” or “us”). By submitting media for transfer or using our services, you agree to these Terms.
By submitting media or requesting services from Retro Media Transfer Lab, the customer agrees to be bound by these Terms and Conditions.
If you do not agree with these terms, please do not submit media for transfer.
Customers represent and warrant that they are the legal owner of the media submitted or have the legal right or permission to reproduce the content.
Retro Media Transfer Lab will not knowingly duplicate commercially produced copyrighted material such as movies, television programs, or other protected content without proper authorization.
The customer assumes all responsibility for ensuring that submitted media complies with applicable copyright laws.
Many analog media formats such as VHS tapes degrade over time due to age, environmental exposure, and prior use.
During normal playback and transfer, media may experience issues including but not limited to:
Tape breakage
Signal loss
Tracking problems
Oxide shedding
Mechanical failure
By submitting media for transfer, the customer acknowledges that playback of aging media carries inherent risk. Retro Media Transfer Lab is not responsible for damage to media that occurs as a result of normal playback or deterioration of the original media.
Media containing mold, biological contamination, or other substances that may damage equipment will not be processed.
If mold or contamination is discovered, service will be declined and the media will be returned to the customer.
Retro Media Transfer Lab reserves the right to refuse any media that poses a risk to equipment or other customer media.
If submitted media is determined to be damaged, warped, improperly assembled, or otherwise likely to damage equipment, we may refuse service or stop processing the media.
This includes situations where tape reels, shells, or other components are compromised.
Retro Media Transfer Lab reserves the right to refuse service for any media that presents a risk to equipment, staff, or other customer materials.
The quality and completeness of transferred media depend entirely on the condition and quality of the original source material.
Retro Media Transfer Lab does not guarantee that:
Content will be fully recoverable
Video or audio quality will meet customer expectations
The entire recording will be successfully transferred
Degraded or damaged media may result in incomplete or poor-quality transfers.
Some media may contain blank recordings, incomplete recordings, or segments that cannot be recovered.
Charges may apply for attempted transfers even if the media cannot be fully recovered or the transfer cannot be completed.
Payment is required before work begins.
Pricing is based on the information provided at the time of order and may be adjusted if the actual media type, length, or condition differs from the original description.
If a submitted item cannot be processed (for example due to mold or severe damage), the applicable portion of the payment will be adjusted or refunded as appropriate.
If additional services are requested after the initial order is placed (such as adding a USB drive or other delivery format), any additional charges must be paid before delivery of the completed work.
Completed transfers will not be delivered until all outstanding balances are paid.
Digital files are delivered in commonly supported formats. However, playback compatibility depends on the customer's device, software, and operating system.
Retro Media Transfer Lab is not responsible for compatibility issues with specific devices or software used by the customer.
Digital files created during the transfer process may be retained for up to 30 days after delivery.
After this period, files may be permanently deleted without notice.
Customers are responsible for creating their own backups once files are delivered.
Customers who ship media to Retro Media Transfer Lab do so at their own risk.
Customers are responsible for proper packaging of their media to prevent damage during transit.
Retro Media Transfer Lab is not responsible for items lost, delayed, or damaged during shipping to or from our location.
Customers are responsible for retrieving their original media and completed transfers in a timely manner.
Items that remain unclaimed for more than 90 days after the customer has been notified that work is complete may be considered abandoned.
Retro Media Transfer Lab reserves the right to dispose of abandoned media after this period.
While reasonable care is taken during the transfer process, digital files may occasionally be affected by hardware failures, software errors, or data corruption.
Retro Media Transfer Lab is not responsible for data loss resulting from technical failures beyond our control.
Retro Media Transfer Lab respects the privacy of customer media.
Customer media content will not be viewed, copied, or shared except as necessary to perform the transfer process or verify the quality of the transfer.
We will not distribute or publish customer media.
Estimated turnaround times may be provided for customer convenience.
However, turnaround times are estimates only and may vary depending on workload, media condition, equipment availability, or other operational factors.
Retro Media Transfer Lab does not guarantee completion by a specific date unless explicitly agreed in writing.
Customers must not submit media containing unlawful content.
If illegal material is discovered during the transfer process, Retro Media Transfer Lab reserves the right to immediately stop processing the media.
We may refuse service and, where required by law, report unlawful material to appropriate authorities.
To the maximum extent permitted by law, the liability of Retro Media Transfer Lab for any claim arising from the services provided shall be limited to the amount paid for the specific service performed.
Retro Media Transfer Lab shall not be liable for indirect, incidental, or consequential damages, including loss of irreplaceable media content.
Customers acknowledge that submitted media may contain unique, irreplaceable, or sentimental content.
Due to the age and condition of many analog media formats, attempting playback or transfer carries inherent risk, including the possibility of damage, degradation, or loss of content.
By submitting media for transfer, the customer accepts these risks and agrees that Retro Media Transfer Lab is not responsible for the loss of irreplaceable or sentimental content beyond the limitation of liability described in these Terms.
Customers are responsible for reviewing delivered digital files and transferred media promptly upon receipt.
Any issues related to missing files, incomplete transfers, or technical problems must be reported within 14 days of delivery.
If no issues are reported within this period, the work will be considered accepted and complete.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
Any disputes arising from services provided by Retro Media Transfer Lab shall be handled within the appropriate courts located in the Commonwealth of Pennsylvania.
